Enforcement Decree of the Road Act, Article 57 (Road Occupancy Subject to General Competition)
① 법 제61조제4항에 따라 일반경쟁에 부치는 방식으로 도로의 점용 허가를 받을 자를 선정할 수 있는 경우는 고가도로 또는 교량의 하부에 대한 도로점용 등 점용수요가 많은 장소로서 도로관리청이 일반경쟁에 부치는 것이 타당하다고 판단하는 경우로 한다. 다만, 신청자의 도로점용 목적이 법 제68조 각 호의 어느 하나에 해당하는 경우에는 제외한다. <개정 2023.10.18>
(1) The cases in which a person to be granted a road occupancy permit may be selected by general competition under Article 61 (4) of the Act are cases where the road management authority deems it appropriate to put the occupancy to general competition at a place with high occupancy demand, such as occupancy of the underside of an elevated road or bridge. However, this does not apply where the applicant's purpose of road occupancy falls under any subparagraph of Article 68 of the Act.
② 법 제61조제4항에 따라 도로관리청이 일반경쟁에 부쳐 도로의 점용 허가를 받을 자를 선정하려는 경우 일반경쟁에 부친다는 뜻을 도로점용허가 신청자에게 통보하고, 「전자조달의 이용 및 촉진에 관한 법률」 제2조제4호에 따른 국가종합전자조달시스템을 이용하여 입찰공고 및 개찰ㆍ낙찰 선언을 하여야 한다. 이 경우 도로관리청은 필요할 때에는 입찰공고를 일간신문 등에 게재하는 방법을 병행할 수 있다. <개정 2023.10.18>
(2) Where a road management authority intends to select a person to be granted a road occupancy permit by general competition under Article 61 (4) of the Act, it shall notify the applicant for the road occupancy permit that the matter will be put to general competition, and shall make the bid announcement and declare bid opening and the successful bidder using the national integrated e-procurement system under Article 2, subparagraph 4 of the Act on the Use and Promotion of Electronic Procurement. In this case, the road management authority may, where necessary, also publish the bid announcement in a daily newspaper or the like.
