도로교통법 시행규칙 제23조(대행법인등의 지정신청 등)

①영 제17조제1항에 따라 대행법인등의 지정을 받으려는 자는 별지 제12호서식의 대행법인등 지정신청서에 다음 각 호의 서류를 첨부하여 관할경찰서장 또는 시장ㆍ군수ㆍ구청장(자치구가 아닌 구의 구청장을 제외한다. 이하 "구청장등"이라 한다)에게 제출해야 한다. 이 경우 전단에 따른 신청서를 받은 관할경찰서장 또는 구청장등은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 법인 등기사항증명서(법인인 경우만 해당한다)를 확인해야 한다. <개정 2007.9.28, 2009.11.27, 2010.9.10, 2022.12.30>

②관할경찰서장 또는 구청장등은 대행법인등을 지정한 때에는 영 제17조제2항에 따라 그 사실을 해당 경찰서 또는 시ㆍ군ㆍ구의 게시판에 공고하고, 별지 제13호서식에 따른 대행업지정증을 교부하여야 한다.

③영 제17조제3항에 따라 대행법인등은 5천만원 이상의 손해배상을 위한 이행보증보험 또는 대행법인등에 갈음하여 피해자의 손해를 배상하는 보험에 가입하거나 그 소재지를 관할하는 공탁기관에 공탁을 하여야 하며, 경찰서장 또는 구청장등은 제2항에 따라 대행업지정증을 교부하는 때에 이를 확인하여야 한다.

④그 밖에 대행법인등의 대행업무수행에 관한 사항으로서 이 규칙에 규정되지 아니한 사항은 시ㆍ도경찰청장이 정한다. <개정 2020.12.31>
