대리점거래의 공정화에 관한 법률 시행령 제5조(판매목표 강제 행위의 유형 또는 기준)
Enforcement Decree of the Act on Fair Transactions in Agency Business, Article 5 (Types or Standards of Acts of Forcing Sales Targets)
법 제8조제1항에 따라 금지되는 행위는 다음 각 호의 어느 하나에 해당하는 행위를 하거나 하겠다는 의사를 표시함으로써 대리점에 공급업자가 공급하는 상품 또는 용역의 판매목표 달성을 강제하는 행위로 한다.
Acts prohibited under Article 8 (1) of the Act are acts of forcing an agency to achieve sales targets for goods or services supplied by the supplier by doing, or expressing an intention to do, any of the following:
1. 대리점 계약을 중도에 해지하는 행위
1. Terminating the agency contract midway;
2. 상품 또는 용역의 공급을 중단하는 행위
2. Suspending the supply of goods or services;
3. 대리점에 지급하여야 하는 금액의 전부 또는 일부를 지급하지 아니하는 행위
3. Failing to pay all or part of the amount to be paid to the agency;
4. 그 밖에 대리점의 정상적인 영업을 방해하는 불이익을 주는 행위로서 공정거래위원회가 정하여 고시하는 행위
4. Other acts of imposing a disadvantage that interferes with the normal business of the agency, as determined and publicly notified by the Fair Trade Commission.
