대리점거래의 공정화에 관한 법률 시행령 제16조(분쟁당사자의 지위승계)

① 협의회는 조정절차가 종료되기 전에 분쟁당사자가 사망하거나 능력의 상실, 그 밖의 사유로 절차를 진행할 수 없는 경우에는 법령에 따라 그 지위를 승계한 자로 하여금 분쟁당사자의 지위를 승계하게 할 수 있다.

② 제1항에 따라 분쟁당사자의 지위를 승계하려는 자는 협의회에 서면으로 지위승계를 신청하여야 한다.

③ 협의회는 제2항에 따른 신청을 받으면 지체 없이 심사하여 승계 여부를 결정하고, 그 내용을 신청한 자에게 서면으로 통지하여야 한다.
