대기환경보전법 시행령 제28조(기본부과금 산정의 방법과 기준)

① 법 제35조제2항제1호에 따른 기본부과금은 배출허용기준 이하로 배출하는 오염물질배출량(이하 "기준이내배출량"이라 한다)에 오염물질 1킬로그램당 부과금액, 연도별 부과금산정지수, 지역별 부과계수 및 농도별 부과계수를 곱한 금액으로 한다. <개정 2013.1.31>

② 제1항에 따른 기본부과금의 산정에 필요한 오염물질 1킬로그램당 부과금액에 관하여는 제24조제2항을 준용하며, 기본부과금의 지역별 부과계수는 별표 7과 같고, 기본부과금의 농도별 부과계수는 별표 8과 같다.

③ 제1항에 따른 연도별 부과금산정지수는 최초의 부과연도를 1로 하고, 그 다음 해부터는 매년 전년도 지수에 전년도 물가상승률 등을 고려하여 기후에너지환경부장관이 정하여 고시하는 가격변동계수를 곱한 것으로 한다. <개정 2025.10.1>
