Tobacco Business Act, Article 16 (Designation of Retailers)

① 담배소매업(직접 소비자에게 판매하는 영업을 말한다)을 하려는 자는 사업장의 소재지를 관할하는 시장ㆍ군수ㆍ구청장으로부터 소매인의 지정을 받아야 한다.

② 시장ㆍ군수ㆍ구청장은 제1항에 따른 소매인의 지정을 받으려는 자가 지정을 신청한 때에는 소매인 지정을 하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 경우에는 그러하지 아니하다. <개정 2020.3.31, 2025.10.1>

1. 다음 각 목의 어느 하나에 해당하는 자인 경우

1. Where웨어 the^ð더 person퍼슨 falls^f폴즈 under언더 any에니 of어^v브 the^ð더 following^f팔로잉 items:아이텀즈

가. 미성년자 또는 피성년후견인ㆍ피한정후견인

(a)어 A어 minor,마이너 a어 person퍼슨 under언더 adult어덜트 guardianship가디언쉽 or오 a어 person퍼슨 under언더 limited리머티드 guardianship;가디언쉽

나. 파산선고를 받고 복권되지 아니한 자

(b)비 A어 person퍼슨 who후 has해즈 been빈 declared디클레어드 bankrupt뱅크^r럽트 and앤드 has해즈 not낫 been빈 reinstated;^r리인스테이티드

다. 이 법을 위반하여 징역의 실형을 선고받고 그 집행이 끝나거나(집행이 끝난 것으로 보는 경우를 포함한다) 집행이 면제된 날부터 1년이 지나지 아니한 사람

(c)시 A어 person퍼슨 for^f포 whom훔 one원 year이어 has해즈 not낫 passed패스트 since신스 the^ð디 execution엑서큐션 of어^v브 a어 sentence센튼스 of어^v브 imprisonment임프^r리전먼트 with위^ð드 labor레이버 was워즈 completed컴플리티드 (including인클루딩 cases케이시즈 deemed딤드 completed)컴플리티드 or오 exempted,이그젬프티드 having해^v빙 been빈 so소우 sentenced센턴스트 for^f포 violating^v바이얼레이팅 this^ð디스 Act;액트

라. 이 법을 위반하여 징역형의 집행유예를 선고받고 그 유예기간 중에 있는 사람

마. 제17조제1항에 따라 지정이 취소(이 호 가목 또는 나목에 해당하여 지정이 취소된 경우는 제외한다)된 날부터 2년이 지나지 아니한 자

(e)이 A어 person퍼슨 for^f포 whom훔 two투 years이어즈 have해^v브 not낫 passed패스트 since신스 designation데저그네이션 was워즈 revoked^r리^v보우크트 under언더 Article아터클 17 (1) (excluding익스클루딩 cases케이시즈 revoked^r리^v보우크트 because비코즈 of어^v브 item아이텀 (a)어 or오 (b)비 of어^v브 this^ð디스 subparagraph);서브패^r러그^r래^f프

바. 대표자가 가목부터 마목까지의 어느 하나에 해당하는 법인

(f)에^f프 A어 corporation코퍼^r레이션 whose후즈 representative^r레프^r러젠터티^v브 falls^f폴즈 under언더 any에니 of어^v브 items아이텀즈 (a)어 through^θ쓰^r루 (e);이

2. 청소년(「청소년 보호법」 제2조제1호에 따른 청소년을 말한다. 이하 같다)이 담배에 쉽게 접근할 수 있는 장소 등 담배판매업을 하는 것이 부적당하다고 인정되는 장소로서 재정경제부령으로 정하는 장소에서 담배를 판매하려는 경우

4. 그 밖에 이 법 또는 다른 법령에 따른 제한에 위반되는 경우

③ 시장ㆍ군수ㆍ구청장은 제1항에 따라 소매인을 지정할 경우 다음 각 호의 사람을 우선하여 지정할 수 있다. <신설 2025.12.23>

(3) In인 designating데지그네이팅 retailers^r리테일러즈 under언더 paragraph패^r러그^r래^f프 (1), the^ð더 head헤드 of어^v브 a어 Si/Gun/Gu시 may메이 give기^v브 priority프^r라이오^r러티 to투 the^ð더 following^f팔로잉 persons:퍼슨즈

1. 「국가유공자 등 예우 및 지원에 관한 법률」 제6조에 따라 등록ㆍ결정된 국가유공자 및 그 가족(같은 세대별 주민등록표에 등재되어 있는 배우자 및 직계존비속으로 한정한다. 이하 제2호에서 같다)

1. 2. 「장애인복지법」 제32조에 따라 등록한 장애인 및 그 가족

④ 제1항에 따라 지정을 받은 소매인은 타인에게 자기의 명의를 사용하여 같은 항에 따른 담배소매업을 영위하게 하여서는 아니 된다. <신설 2025.12.23>

(4) A어 retailer^r리테일러 designated데지그네이티드 under언더 paragraph패^r러그^r래^f프 (1) shall섈 not낫 allow얼라우 another어너^ð더 person퍼슨 to투 engage엔게이지 in인 the^ð더 tobacco터배코우 retail^r리테일 business비즈니스 under언더 paragraph패^r러그^r래^f프 (1) using유징 the^ð더 retailer's^r리테일러즈 name.네임
