장애인복지법 제32조(장애인 등록)

①장애인, 그 법정대리인 또는 대통령령으로 정하는 보호자(이하 "법정대리인등"이라 한다)는 장애 상태와 그 밖에 보건복지부령이 정하는 사항을 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수 또는 구청장(자치구의 구청장을 말한다. 이하 같다)에게 등록하여야 하며, 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 등록을 신청한 장애인이 제2조에 따른 기준에 맞으면 장애인등록증(이하 "등록증"이라 한다)을 내주어야 한다. <개정 2008.2.29, 2010.1.18, 2010.5.27, 2015.6.22, 2017.2.8>

② 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따라 등록증을 발급받은 장애인이 등록증과 효력이 동일한 모바일 등록증(「전기통신사업법」 제2조제20호에 따른 이동통신단말장치에 암호화된 형태로 설치된 등록증을 말한다. 이하 같다)의 발급을 신청하는 경우에는 이를 추가로 발급할 수 있다. <신설 2025.4.22>

③ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따라 등록증을 받은 장애인의 장애 상태의 변화에 따른 장애 정도 조정을 위하여 장애 진단을 받게 하는 등 장애인이나 법정대리인등에게 필요한 조치를 할 수 있다. <개정 2017.2.8, 2017.12.19>

④등록증(모바일 등록증을 포함한다. 이하 같다)은 양도하거나 대여하지 못하며, 등록증과 유사한 명칭이나 표시를 사용하여서는 아니 된다. <개정 2025.4.22>

⑥ 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 제1항에 따른 장애인 등록 및 제3항에 따른 장애 상태의 변화에 따른 장애 정도를 조정함에 있어 장애인의 장애 인정과 장애 정도 사정이 적정한지를 확인하기 위하여 필요한 경우 대통령령으로 정하는 「공공기관의 운영에 관한 법률」 제4조에 따른 공공기관에 장애 정도에 관한 정밀심사를 의뢰할 수 있다. <신설 2010.5.27, 2015.6.22, 2015.12.29, 2017.12.19>

⑧ 보건복지부장관 또는 특별자치시장ㆍ특별자치도지사ㆍ시장ㆍ군수ㆍ구청장은 「사회보장기본법」 제37조에 따른 사회보장정보시스템을 이용하여 등록증의 진위 또는 유효 여부 확인이 필요한 경우에 이를 확인하여 줄 수 있다. <개정 2024.2.13>
