농업생명자원의 보존ㆍ관리 및 이용에 관한 법률 시행령 제11조(관리기관의 지정 갱신)

① 법 제15조제4항에 따라 관리기관 지정을 갱신받으려는 자는 유효기간이 끝나기 60일 전까지 농림축산식품부령으로 정하는 농업생명자원 관리기관 갱신신청서에 다음 각 호의 서류를 첨부하여 책임기관의 장에게 제출하여야 한다. <개정 2013.3.23, 2017.6.27>

② 책임기관의 장은 제1항에 따라 갱신신청을 받으면 신청서를 받은 날부터 30일 이내에 심사 절차를 거쳐 갱신 여부를 결정하여야 한다. 다만, 부득이한 사유가 있을 때에는 30일의 범위에서 기간을 정하여 지정 여부의 결정 기간을 한 차례만 연장할 수 있으며, 이 경우 기간을 연장한 사실과 그 사유를 신청인에게 서면(전자문서를 포함한다)으로 알려야 한다.

③ 책임기관의 장은 제2항에 따라 제출된 신청서 및 첨부서류에 보완이 필요한 경우에는 일정한 기간을 정하여 보완하게 할 수 있다. 이 경우 보완에 걸리는 기간은 제3항에 따른 기간에 산입하지 아니한다.

④ 책임기관의 장은 관리기관 지정의 유효기간이 끝나기 90일 전에 관리기관의 장에게 유효기간 만료일과 갱신 절차 등을 미리 알려야 한다.

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 갱신 절차 및 방법에 필요한 사항은 책임기관의 장이 정한다.
