농업ㆍ농촌 공익기능 증진 직접지불제도 운영에 관한 법률 시행규칙 제16조(기본직접지불금 등록사항의 변경등록 등)

① 법 제16조제1항에서 "농림축산식품부령으로 정하는 등록사항"이란 다음 각 호에 관한 등록사항을 말한다.

② 법 제16조제1항에 따라 변경등록을 하려는 자는 별지 제7호서식에 따른 기본직접지불금 지급대상자 변경등록신청서에 다음 각 호의 서류를 첨부하여 매년 농림축산식품부장관이 정하여 공고하는 날까지 읍ㆍ면장을 거쳐 시장ㆍ군수ㆍ구청장등에게 제출해야 한다. <개정 2022.5.18>

③ 시장ㆍ군수ㆍ구청장등은 제2항에 따라 변경등록신청서를 제출받으면 지급대상 농지등의 변경사항을 확인한 후 변경등록 신청 내용에 이상이 없는 경우에는 등록대장에 변경등록을 하고, 읍ㆍ면장을 거쳐 신청인에게 등록증을 다시 발급해야 한다.

④ 법 제16조제2항 또는 제3항에 따라 농지등의 양수(讓受)ㆍ임차 또는 사용차(使用借)를 신고하거나 기본직접지불금 등록자의 지위 승계를 신고하려는 자는 별지 제8호서식에 따른 기본직접지불금 지급대상자 변경등록신고서(이하 이 조에서 "변경신고서"라 한다)에 다음 각 호의 서류를 첨부하여 매년 농림축산식품부장관이 정하여 공고하는 날까지 읍ㆍ면장을 거쳐 시장ㆍ군수ㆍ구청장등에게 제출해야 한다. <개정 2022.5.18>

⑤ 시장ㆍ군수ㆍ구청장등은 제4항에 따라 변경신고서를 제출받으면 기본직접지불금 지급대상자 여부 등을 확인한 후 기본직접지불금 지급대상자로 인정되면 등록대장에 변경등록을 하고, 읍ㆍ면장을 거쳐 신고인에게 등록증을 다시 발급해야 한다.

⑥ 제3항 및 제5항에 따라 등록증을 받은 자가 등록내용에 대해 이의가 있는 경우의 재심사에 관하여는 제15조를 준용한다.
