농어촌정비법 제34조(특정 용도의 창설환지 등)

① 농업생산기반 정비사업 시행자는 그 사업계획에서 정하여진 다음 각 호의 용도에 필요한 토지를 환지로 지정할 수 있다.

② 제1항에 따라 환지를 지정하는 경우에는 국가, 지방자치단체, 농업생산기반 정비사업 시행자 및 농림축산식품부령으로 정하는 자 중에서 사전에 동의한 자에게 환지를 지정한다. 다만, 농업생산기반 정비사업 시행자에게 농업생산기반시설 용지를 환지로 지정하는 경우에는 별도의 동의가 필요하지 아니하다. <개정 2012.2.17, 2013.3.23>

③ 제1항에 따라 환지를 지정하는 경우에는 농림축산식품부령으로 정하는 것 외에는 금전으로 청산을 하되, 그 금액을 지급하고 징수하는 방법 및 시기를 그 환지계획에서 정하여야 한다. <개정 2013.3.23>

④ 제2항에 따라 취득한 환지는 농림축산식품부령으로 정하는 바에 따라 관리ㆍ처분한다. <개정 2013.3.23>

⑤ 환지계획 구역에 농경지 외의 특정 용도로 이용하는 종전의 토지가 있는 경우에는 그 사업계획에서 정하여진 농경지 외의 특정 용도 구역에 그 용도가 보장될 수 있도록 지정하여야 한다. 다만, 토지 소유자가 동의한 경우에는 그러하지 아니하다.

⑥ 농업생산기반 정비사업 시행자는 토지 소유자가 신청하거나 동의할 경우에는 종전 토지를 대신하여 사업 시행으로 조성된 부지를 포함하는 건축물의 전부 또는 일부를 환지로 지정할 수 있다.
