농어촌정비법 제20조(농업생산기반시설에 대한 비상대처계획의 수립 등)

① 저수지 축조 등 대통령령으로 정하는 농업생산기반시설을 설치하려는 자는 농업생산기반시설을 착공한 후 1년 이내에 농업생산기반시설 붕괴 등의 비상 상황으로 발생할 수 있는 국민의 생명ㆍ재산의 피해를 예방하고 줄이는 데에 필요한 종합적인 대처계획(이하 "비상대처계획"이라 한다)을 세워야 한다. 이 경우 미리 관계 행정기관의 장과 협의하여야 한다.

② 비상대처계획을 세운 자는 지체 없이 관계 행정기관의 장에게 수립된 비상대처계획을 알려야 한다. 이 경우 통지를 받은 관계 행정기관의 장은 비상대처계획의 실행에 필요한 조치를 하여야 한다.

③ 비상대처계획을 세운 자는 농업생산기반시설의 착공 또는 준공 후에 농업생산기반시설과 관련한 중대한 변화가 있으면 그 내용을 반영하여 비상대처계획을 변경하여야 한다. 비상대처계획의 변경에 관하여는 제1항 후단과 제2항을 준용한다.

④ 비상대처계획에 포함되어야 할 사항과 비상대처계획의 수립ㆍ변경에 관한 세부적인 사항은 대통령령으로 정한다.
