농어촌정비법 시행규칙 제12조(농업생산기반시설의 등록 절차)

① 법 제17조, 영 제25조제1항 및 제2항에 따라 농업생산기반시설관리자가 농업생산기반시설을 등록 또는 변경등록하려면 별지 제7호서식의 농업생산기반시설 등록 또는 변경등록 신청서에 다음 각 호의 서류를 첨부하여 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장에게 제출해야 한다. 다만, 변경등록의 경우에는 다음 각 호의 서류 중 해당되는 서류만 첨부하여 제출한다. <개정 2012.5.18, 2019.7.16, 2020.8.20, 2025.4.23>

② 제1항에 따른 농업생산기반시설 등록 또는 변경등록 신청서를 제출받은 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 농업생산기반시설부지(용수로, 배수로 및 농로의 경우는 제외한다)의 토지(건물)등기사항증명서, 토지(임야)대장 및 지적도(수혜구역에 대하여 축척 1천분의 1부터 5만분의 1까지의 지형도가 작성되지 않은 경우로 한정한다)를 확인해야 한다. <개정 2011.10.31, 2012.5.18, 2023.1.6, 2025.4.23>

③ 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 제1항에 따른 농업생산기반시설 등록 또는 변경등록의 신청을 받으면 그 서류를 심사하여 별지 제15호서식의 농업생산기반시설 등록대장에 기재하고, 제1항 각 호의 서류 중 농업생산기반시설 등록부는 1부를 등록기관에 보관하며, 1부는 별지 제16호서식의 농업생산기반시설 등록증명서에 첨부하여 신청인에게 주어야 한다. <개정 2012.5.18>
