농수산물 품질관리법 제85조(재검사 등)

① 제79조제1항에 따른 농산물의 검사 결과에 대하여 이의가 있는 자는 검사현장에서 검사를 실시한 농산물검사관에게 재검사를 요구할 수 있다. 이 경우 농산물검사관은 즉시 재검사를 하고 그 결과를 알려 주어야 한다.

② 제1항에 따른 재검사의 결과에 이의가 있는 자는 재검사일부터 7일 이내에 농산물검사관이 소속된 농산물검사기관의 장에게 이의신청을 할 수 있으며, 이의신청을 받은 기관의 장은 그 신청을 받은 날부터 5일 이내에 다시 검사하여 그 결과를 이의신청자에게 알려야 한다.

③ 제1항 또는 제2항에 따른 재검사 결과가 제79조제1항에 따른 검사 결과와 다른 경우에는 제84조를 준용하여 해당 검사결과의 표시를 교체하거나 검사증명서를 새로 발급하여야 한다.
