농수산물 품질관리법 제28조의2(행정제재처분 효과의 승계)

제28조에 따라 지위를 승계한 경우 종전의 우수관리인증기관, 우수관리시설 또는 품질인증기관에 행한 행정제재처분의 효과는 그 처분이 있은 날부터 1년간 그 지위를 승계한 자에게 승계되며, 행정제재처분의 절차가 진행 중인 때에는 그 지위를 승계한 자에 대하여 그 절차를 계속 진행할 수 있다. 다만, 지위를 승계한 자가 그 지위의 승계 시에 그 처분 또는 위반사실을 알지 못하였음을 증명하는 때에는 그러하지 아니하다.
