농수산물 유통 및 가격안정에 관한 법률 제38조의2(출하 농수산물의 안전성 검사)

① 도매시장 개설자는 해당 도매시장에 반입되는 농수산물에 대하여 「농수산물 품질관리법」 제61조에 따른 유해물질의 잔류허용기준 등의 초과 여부에 관한 안전성 검사를 하여야 한다. 이 경우 도매시장 개설자 중 시는 제17조제1항 단서에 따라 해당 도매시장의 개설을 허가한 도지사 소속의 검사기관에 안전성 검사를 의뢰할 수 있다. <개정 2011.7.21, 2014.3.24>

② 도매시장 개설자는 제1항에 따른 안전성 검사 결과 그 기준에 못 미치는 농수산물을 출하하는 자에 대하여 1년 이내의 범위에서 해당 농수산물과 같은 품목의 농수산물을 해당 도매시장에 출하하는 것을 제한할 수 있다. 이 경우 다른 도매시장 개설자로부터 안전성 검사 결과 출하 제한을 받은 자에 대해서도 또한 같다. <개정 2018.12.31>

③ 제1항에 따른 안전성 검사의 실시 기준 및 방법과 제2항에 따른 출하제한의 기준 및 절차 등에 관하여 필요한 사항은 농림축산식품부령 또는 해양수산부령으로 정한다. <개정 2013.3.23>
