Act on Distribution and Price Stabilization of Agricultural and Fishery Products, Article 23 (Designation and Re-Designation of Wholesale Market Corporations)

① 도매시장법인은 도매시장 개설자가 부류별로 공모하여 지정하되, 중앙도매시장에 두는 도매시장법인의 경우에는 농림축산식품부장관 또는 해양수산부장관과 협의하여 지정한다. 이 경우 5년 이상 10년 이하의 범위에서 지정 유효기간을 설정할 수 있다. <개정 2012.2.22, 2013.3.23, 2026.2.27>

② 도매시장법인의 주주 및 임직원은 해당 도매시장법인의 업무와 경합되는 도매업 또는 중도매업(仲都賣業)을 하여서는 아니 된다. 다만, 제23조의2에 따라 도매시장법인이 다른 도매시장법인의 주식 또는 지분을 과반수 이상 양수(이하 "인수"라 한다)하고 양수법인의 주주 또는 임직원이 양도법인의 주주 또는 임직원의 지위를 겸하게 된 경우에는 그러하지 아니하다.

③ 제1항에 따른 도매시장법인이 될 수 있는 자는 다음 각 호의 요건을 갖춘 법인이어야 한다. <개정 2014.3.24, 2015.2.3>

1. 해당 부류의 도매업무를 효과적으로 수행할 수 있는 지식과 도매시장 또는 공판장 업무에 2년 이상 종사한 경험이 있는 업무집행 담당 임원이 2명 이상 있을 것

5. 거래규모, 순자산액 비율 및 거래보증금 등 도매시장 개설자가 업무규정으로 정하는 일정 요건을 갖출 것

⑤ 도매시장법인은 해당 임원이 제3항제2호부터 제4호까지의 어느 하나에 해당하는 요건을 갖추지 아니하게 되었을 때에는 그 임원을 지체 없이 해임하여야 한다.

⑥ 도매시장법인이 제1항 또는 제7항에 따른 지정 유효기간의 만료 후 계속하여 업무를 하려는 경우에는 유효기간 만료 90일 전까지 도매시장 개설자에게 재지정을 신청하여야 한다. <신설 2026.2.27>

⑦ 제6항에 따른 신청을 받은 도매시장 개설자는 3년 이상 5년 이하의 범위에서 지정 유효기간을 설정하여 도매시장법인을 재지정할 수 있다. 다만, 중앙도매시장의 개설자가 도매시장법인을 재지정하려는 경우에는 농림축산식품부장관 또는 해양수산부장관과 협의하여야 한다. <신설 2026.2.27>
