농수산물 유통 및 가격안정에 관한 법률 제10조(유통협약 및 유통조절명령)

① 주요 농수산물의 생산자, 산지유통인, 저장업자, 도매업자ㆍ소매업자 및 소비자 등(이하 "생산자등"이라 한다)의 대표는 해당 농수산물의 자율적인 수급조절과 품질향상을 위하여 생산조정 또는 출하조절을 위한 협약(이하 "유통협약"이라 한다)을 체결할 수 있다.

② 농림축산식품부장관 또는 해양수산부장관은 부패하거나 변질되기 쉬운 농수산물로서 농림축산식품부령 또는 해양수산부령으로 정하는 농수산물에 대하여 현저한 수급 불안정을 해소하기 위하여 특히 필요하다고 인정되고 농림축산식품부령 또는 해양수산부령으로 정하는 생산자등 또는 생산자단체가 요청할 때에는 공정거래위원회와 협의를 거쳐 일정 기간 동안 일정 지역의 해당 농수산물의 생산자등에게 생산조정 또는 출하조절을 하도록 하는 유통조절명령(이하 "유통명령"이라 한다)을 할 수 있다. <개정 2013.3.23>

③ 유통명령에는 유통명령을 하는 이유, 대상 품목, 대상자, 유통조절방법 등 대통령령으로 정하는 사항이 포함되어야 한다.

④ 제2항에 따라 생산자등 또는 생산자단체가 유통명령을 요청하려는 경우에는 제3항에 따른 내용이 포함된 요청서를 작성하여 이해관계인ㆍ유통전문가의 의견수렴 절차를 거치고 해당 농수산물의 생산자등의 대표나 해당 생산자단체의 재적회원 3분의 2 이상의 찬성을 받아야 한다.

⑤ 제2항에 따른 유통명령을 하기 위한 기준과 구체적 절차, 유통명령을 요청할 수 있는 생산자등의 조직과 구성 및 운영방법 등에 관하여 필요한 사항은 농림축산식품부령 또는 해양수산부령으로 정한다. <개정 2013.3.23>
