Enforcement Decree of the Framework Act on Carbon Neutrality and Green Growth for Coping with Climate Crisis, Article 4 (Inspection of Implementation Status)
① 법 제15조제1항에 따른 국가기후위기대응위원회의 위원장은 법 제9조제1항에 따른 이행현황 점검을 실시하기 위하여 매년 점검계획을 수립해야 한다. <개정 2026.3.31>
(1) The chairperson of the National Commission on Climate Crisis Response under Article 15 (1) of the Act shall establish an inspection plan each year to conduct the inspection of implementation status under Article 9 (1) of the Act.
② 법 제9조제1항에 따른 이행현황 점검은 서면점검으로 실시하되, 필요한 경우 현장점검으로 실시할 수 있다.
(2) The inspection of implementation status under Article 9 (1) of the Act shall be conducted as a written inspection, and may be conducted as an on-site inspection where necessary.
③ 기후에너지환경부장관은 법 제9조제1항에 따른 이행현황 점검에 관한 업무를 지원한다. <개정 2025.10.1>
(3) The Minister of Climate, Energy and Environment shall support work relating to the inspection of implementation status under Article 9 (1) of the Act.
④ 법 제15조제1항에 따른 국가기후위기대응위원회의 위원장은 법 제9조제1항에 따른 이행현황 점검 및 결과 보고서의 작성을 위하여 필요한 경우 관계 행정기관의 장에게 관련 자료의 제출을 요청할 수 있다. <개정 2026.3.31>
(4) The chairperson of the National Commission on Climate Crisis Response under Article 15 (1) of the Act may request the head of a relevant administrative agency to submit related data where necessary to conduct the inspection of implementation status under Article 9 (1) of the Act and to prepare the result report.
⑤ 법 제15조제1항에 따른 국가기후위기대응위원회의 위원장은 법 제9조제1항에 따라 작성한 결과 보고서를 해당 위원회의 심의를 거쳐 그 위원회의 인터넷 홈페이지에 공개해야 한다. <개정 2022.9.20, 2026.3.31>
(5) The chairperson of the National Commission on Climate Crisis Response under Article 15 (1) of the Act shall, after deliberation by that Commission, disclose the result report prepared under Article 9 (1) of the Act on the Commission's internet website.
⑥ 법 제9조제2항에서 "대통령령으로 정하는 사항"이란 다음 각 호의 사항을 말한다. <개정 2026.3.31>
(6) The term "matters prescribed by Presidential Decree" in Article 9 (2) of the Act means the following matters:
1. 법 제8조제3항에 따른 연도별 온실가스 감축 목표(이하 "연도별감축목표"라 한다)의 이행현황에 대한 이해관계자의 의견수렴 결과
1. Results of collecting stakeholder opinions on the implementation status of the annual greenhouse gas reduction targets under Article 8 (3) of the Act (hereinafter referred to as the "annual reduction targets")
2. 연도별감축목표의 이행현황을 확인하기 위하여 법 제15조제1항에 따른 국가기후위기대응위원회의 위원장이 필요하다고 인정하는 사항
2. Matters that the chairperson of the National Commission on Climate Crisis Response under Article 15 (1) of the Act deems necessary to verify the implementation status of the annual reduction targets
⑦ 중앙행정기관의 장, 지방자치단체의 장 및 공공기관의 장은 법 제9조제5항에 따라 부진사항 또는 개선사항을 정책 등에 반영하지 않는 이유를 통지하는 경우에는 서면으로 해야 한다. <신설 2026.5.6>
(7) When the head of a central administrative agency, the head of a local government, or the head of a public institution notifies the reasons for not reflecting delayed or improvable matters in policies, etc. under Article 9 (5) of the Act, the notification shall be in writing.
⑧ 법 제9조제6항에 따른 온실가스 감축 계획 작성ㆍ제출 또는 보완 의무 미이행 내용의 공표는 법 제15조제1항에 따른 국가기후위기대응위원회의 인터넷 홈페이지에 게시하는 방법으로 한다. <신설 2026.5.6>
(8) Public disclosure of non-performance of the obligation to prepare, submit, or supplement a greenhouse gas reduction plan under Article 9 (6) of the Act shall be made by posting it on the internet website of the National Commission on Climate Crisis Response under Article 15 (1) of the Act.
⑨ 제1항부터 제8항까지에서 규정한 사항 외에 연도별감축목표의 이행현황 점검에 필요한 사항은 법 제15조제1항에 따른 국가기후위기대응위원회의 의결을 거쳐 해당 위원회의 위원장이 정한다. <개정 2026.3.31, 2026.5.6>
(9) Matters necessary for the inspection of implementation status of the annual reduction targets, other than those prescribed in paragraphs (1) through (8), shall be determined by the chairperson of the National Commission on Climate Crisis Response under Article 15 (1) of the Act after a resolution of that Commission.
