기후위기 대응을 위한 탄소중립ㆍ녹색성장 기본법 시행령 제21조(온실가스배출관리업체에 대한 목표관리 방법 및 절차)

① 법 제27조제1항에 따라 부문별관장기관의 장은 제2항에 따른 이행연도별 온실가스 관리목표를 온실가스배출관리업체와의 협의 및 위원회의 심의를 거쳐 설정한 후 다음 각 호의 구분에 따른 날까지 온실가스배출관리업체에 통보하고, 그 사실을 법 제27조제4항에 따른 등록부(이하 "온실가스배출관리업체등록부"라 한다)에 기재해야 한다. <개정 2025.4.8>

② 제1항에 따라 온실가스관리목표를 통보받은 온실가스배출관리업체는 이행연도[계획기간의 각 연도(신규진입자의 경우에는 지정연도 다음다음 연도부터 그 연도가 속하는 계획기간의 마지막 연도까지의 각 연도를 말한다)를 말한다. 이하 같다] 전년도의 12월 31일까지 다음 각 호의 사항이 포함된 온실가스관리목표의 이행계획을 부문별관장기관의 장에게 제출해야 한다. <개정 2025.4.8, 2025.10.1>

③ 제2항에 따라 온실가스관리목표의 이행계획을 제출받은 부문별관장기관의 장은 그 내용을 확인하여 해당 이행연도의 1월 31일까지 등록부를 작성해야 한다. <개정 2025.4.8>

④ 온실가스배출관리업체는 제1항에 따라 설정된 온실가스관리목표에 이의가 있는 경우에는 온실가스관리목표를 통보받은 날부터 30일 이내에 부문별관장기관의 장에게 소명 자료를 첨부하여 이의를 신청할 수 있다.

⑤ 온실가스배출관리업체는 법 제27조제3항 전단에 따라 각 이행연도의 온실가스 배출량 명세서(이하 "온실가스배출량명세서"라 한다)에 「온실가스 배출권의 할당 및 거래에 관한 법률」 제24조의2제1항 전단에 따른 외부 검증 전문기관(이하 "검증기관"이라 한다)의 검증 결과를 첨부하여 부문별관장기관의 장에게 해당 이행연도 다음 연도의 3월 31일까지 제출해야 한다. 다만, 신규진입자는 다음 각 호의 구분에 따른 온실가스배출량명세서(검증기관의 검증 결과를 첨부한 것을 말한다)를 해당 호에서 정한 날까지 추가로 제출해야 한다. <개정 2025.4.8>

⑥ 온실가스배출량명세서에는 다음 각 호의 사항이 포함되어야 한다. <개정 2025.10.1>

⑦ 제5항에 따라 온실가스배출량명세서를 제출받은 부문별관장기관의 장은 그 내용을 검토한 후 각 이행연도 다음 연도의 8월 31일까지 온실가스배출량명세서의 내용과 검증 결과를 온실가스배출관리업체등록부에 기재해야 한다. <개정 2025.4.8>

⑧ 부문별관장기관의 장은 온실가스배출관리업체가 제5항에 따라 제출한 각 이행연도의 온실가스배출량명세서를 바탕으로 온실가스배출관리업체의 온실가스관리목표 달성 여부를 위원회의 심의를 거쳐 결정하고, 그 결과를 해당 이행연도 다음 연도의 9월 30일까지 온실가스배출관리업체등록부에 기재해야 한다. <개정 2025.4.8>

⑨ 부문별관장기관의 장은 제8항에 따라 온실가스배출관리업체가 온실가스관리목표를 달성하지 못하였다고 결정한 경우에는 온실가스배출관리업체에 법 제27조제6항에 따른 개선명령을 하고, 그 사실을 온실가스배출관리업체등록부에 기재해야 한다.

⑩ 제9항에 따른 개선명령을 받은 온실가스배출관리업체는 법 제27조제6항 후단에 따라 개선계획을 수립하여 다음 이행연도의 이행계획을 수립할 때 이를 반영해야 한다. <개정 2025.4.8>

⑪ 제1항부터 제10항까지에서 규정한 사항 외에 온실가스배출관리업체의 온실가스관리목표의 설정ㆍ관리, 온실가스배출량명세서의 작성ㆍ보고 및 개선명령 등에 필요한 세부사항은 기후에너지환경부장관이 부문별관장기관의 장과의 협의를 거쳐 정한다. <개정 2025.10.1>
