기초연금법 제6조(국민연금 급여액등에 따른 기초연금액 산정의 특례)

① 제5조에도 불구하고 제5조제4항 각 호 또는 같은 조 제6항에 해당하는 사람 중 「국민연금법」 및 「국민연금과 직역연금의 연계에 관한 법률」에 의한 수급권에 따라 매월 지급 받을 수 있는 급여액(「국민연금법」 제52조에 따른 부양가족연금액을 제외한 금액으로 한다. 이하 "국민연금 급여액등"이라 한다)이 기준연금액의 100분의 150 이하인 사람에게 지급하는 기초연금액은 기준연금액으로 한다. <개정 2018.3.27>

② 제5조에도 불구하고 제5조제4항 각 호 또는 같은 조 제6항에 해당하는 사람 중 국민연금 급여액등이 기준연금액의 100분의 150 초과 100분의 200 이하인 사람에게 지급하는 기초연금액은 기준연금액의 범위에서 대통령령으로 정하는 바에 따라 제5조에 따라 산정된 금액 이상으로 달리 정할 수 있다. <개정 2018.3.27>
