기업활동 규제완화에 관한 특별조치법 시행령 제12조(안전관리자의 범위 등)

① 법 제29조제2항제4호 및 같은 조 제3항제6호에서 "대통령령으로 정하는 특정소방대상물"이란 각각 「화재의 예방 및 안전관리에 관한 법률 시행령」 제26조제1호의 특급 소방안전관리대상물 및 같은 조 제2호의 1급 소방안전관리대상물을 말한다. <신설 2023.6.27>

② 법 제29조제5항ㆍ제30조제4항 및 제31조제2항에 따른 안전관리자의 범위는 다음 각 호와 같다. <개정 2015.7.24, 2023.6.27>

④ 법 제29조제2항 및 제3항에 따른 주된 영업분야 등은 해당 사업장에서 매출액이 가장 많은 영업분야로서 그 매출액이 해당 사업장의 총매출액의 40퍼센트(해당 사업장의 영업분야가 셋 이하인 경우에는 50퍼센트) 이상을 차지하는 영업분야로 한다. 다만, 매출액이 없거나 매출액의 산정이 불가능한 사업장의 경우에는 그 사업장에서 종사하는 상시근로자 수가 가장 많은 영업분야로서 그 근로자 수가 해당 사업장의 전체 상시근로자 수의 40퍼센트(해당 사업장의 영업분야가 셋 이하인 경우에는 50퍼센트) 이상을 차지하는 영업분야로 한다. <개정 2023.6.27>

⑤ 제4항에도 불구하고 법 제29조제2항에 따라 안전관리자 등을 채용하여야 하는 자로서 다음 각 호의 어느 하나에 해당하는 자가 다음 각 호의 어느 하나의 기준에 해당하는 분야가 있는 경우에는 그 분야를 해당 사업장의 주된 영업분야 등으로 본다. <개정 2015.7.24, 2017.1.26, 2022.11.29, 2023.6.27>

⑥ 제4항 본문에 따른 매출액은 해당 사업장의 직전 사업연도의 매출액으로 한다. 다만, 직전 사업연도의 매출액이 없거나 해당 사업연도에 사업이 시작된 경우에는 해당 사업연도의 매출액으로 한다. <개정 2023.6.27>

⑦ 제5항 각 호의 어느 하나에 해당하는 분야가 둘 이상인 경우에는 해당 사업장의 산업안전보건위원회(「산업안전보건법」 제24조에 따른 산업안전보건위원회를 말한다)의 심의를 거쳐 해당 사업장의 책임자가 결정하는 분야를 주된 영업분야 등으로 본다. <개정 2019.12.24, 2023.6.27>

⑧ 상시근로자 300명 미만을 사용하는 사업장에서 「산업안전보건법」 제18조에 따른 보건관리자와 「대기환경보전법」 제40조에 따른 환경기술인의 기술자격을 함께 보유한 사람 1명을 채용한 경우에는 법 제29조제4항에 따라 「산업안전보건법」 제18조에 따른 보건관리자와 「대기환경보전법」 제40조에 따른 환경기술인 각 1명을 채용한 것으로 본다. <개정 2019.12.24, 2023.6.27>
