급경사지 재해예방에 관한 법률 제17조(재해예방을 위한 긴급안전조치 등)

① 시장ㆍ군수ㆍ구청장은 제5조에 따라 안전점검을 실시한 결과 붕괴위험이 있는 관할 구역의 급경사지에서 재해가 발생하였거나 발생할 우려가 있는 때에는 대통령령으로 정하는 바에 따라 관계인에게 관련 시설의 사용을 제한ㆍ금지하거나 보수ㆍ보강 또는 제거하는 등의 안전조치를 명령할 수 있다. 이 경우 시장ㆍ군수ㆍ구청장은 해당 급경사지 주변에 안전조치명령이 있었다는 사실을 알리는 표지를 설치하고, 지방자치단체의 공보 또는 인터넷 홈페이지 등에 그 사실을 게재하여야 한다. <개정 2017.3.21, 2024.2.13>

② 제1항의 안전조치명령을 받은 관계인이 안전조치를 이행한 때에는 행정안전부령으로 정하는 바에 따라 그 결과를 시장ㆍ군수ㆍ구청장에게 통보하여야 한다. <개정 2008.2.29, 2013.3.23, 2014.11.19, 2017.7.26>

③ 시장ㆍ군수ㆍ구청장은 제1항에 따른 안전조치명령을 받은 자가 그 명령을 이행하지 아니하는 경우에는 그에 대신하여 필요한 안전조치를 취할 수 있다. 이 경우 「행정대집행법」 을 준용한다.
