Financial Holding Companies Act, Article 9 (Special Provisions on Foreign Banks, etc.)

① 금융위원회는 외국에서 은행업을 주로 수행하는 회사 또는 해당 법인의 지주회사(이하 이 조에서 "외국은행등"이라 한다)를 포함하는 동일인이 제2조제1항제8호가목 및 나목에 해당하는지를 판단할 때 외국은행등이 다음 각 호의 요건을 모두 충족하는 경우로서 해당 외국은행등이 신청한 경우에는 같은 항 제7호에도 불구하고 해당 외국은행등이 직접적ㆍ간접적으로 주식 또는 출자지분을 보유하는 외국법인으로서 외국법에 따라 설립된 법인(또는 이에 준하는 것으로서 금융위원회가 인정하는 단체나 조합 등을 포함한다)을 동일인의 범위에서 제외할 수 있다. 다만, 해당 외국법인이 해당 외국은행등이 주식을 보유하는 은행지주회사의 주식을 직접적ㆍ간접적으로 보유하는 경우에는 그러하지 아니하다.
