금융위원회의 설치 등에 관한 법률 제61조(금융위원회 등의 명령권 등)

① 금융위원회나 증권선물위원회는 금융감독원의 업무를 지도ㆍ감독하는 데 필요한 명령을 할 수 있다.

② 금융위원회는 증권선물위원회나 금융감독원의 처분이 위법하거나 공익 보호 또는 예금자 등 금융 수요자 보호 측면에서 매우 부당하다고 인정하면 그 처분의 전부 또는 일부를 취소하거나 그 집행을 정지시킬 수 있다.

③ 증권선물위원회는 제19조 각 호의 업무에 관한 금융감독원의 처분이 위법하거나 매우 부당하다고 인정할 때에는 그 처분의 전부 또는 일부를 취소하거나 그 집행을 정지시킬 수 있다.
