군인의 지위 및 복무에 관한 기본법 제45조의2(군복무 중 사망한 군인의 유족에 대한 변호사 선임의 특례)

① 군복무 중 사망한 군인의 유족(「군인연금법」 제3조제1항제4호에 해당하는 사람을 말한다. 이하 같다)은 사망사고 처리 과정에서 유족의 연금ㆍ보상 및 국가유공ㆍ국가보훈의 대상 등에 관한 법률적 조력을 보장받기 위하여 변호사를 선임할 수 있다.

② 제1항에 따른 변호사는 사망한 군인과 관련하여 군검사 또는 군사법경찰관의 검시(檢視) 및 유족에 대한 조사에 참여하여 의견을 진술할 수 있다. 다만, 검시ㆍ조사 도중에는 군검사 또는 군사법경찰관의 승인을 받아 의견을 진술할 수 있다.

③ 군검사는 유족에게 변호사가 없는 경우 국선변호사를 선정하여 사망사고 처리 과정에서 유족의 권익을 보호할 수 있다.
