군인연금법 제42조(기여금)

① 군인은 군인으로 임용된 날이 속하는 달부터 퇴직한 날의 전날 또는 사망한 날이 속하는 달까지 월별로 기여금을 내야 하며, 그 납부 방법 및 절차는 대통령령으로 정한다.

② 기여금은 기준소득월액의 7퍼센트로 한다. 이 경우 기준소득월액은 공무원 전체의 기준소득월액 평균액의 180퍼센트를 초과할 수 없다.

③ 제5조제4항에 따라 복무기간이 산입되는 사람은 그 산입기간에 대하여 국방부장관이 산입을 승인한 날이 속하는 달의 다음 달부터 해당 월분의 기여금과 같은 금액의 소급기여금을 내야 한다. 이 경우 해당 군인이 그 소급기여금의 납부 중 퇴직하거나 사망하였을 때에는 퇴직 또는 사망 당시의 기준소득월액을 기준으로 남은 소급기여금을 계산하여 이를 해당 퇴직급여 또는 퇴직유족급여에서 공제한다.

④ 제3항 전단에 따라 소급기여금을 내는 사람이 그 소급기여금을 한꺼번에 내려는 경우에는 내려는 달의 해당 월분의 기여금액을 기준으로 남은 소급기여금을 계산하여 한꺼번에 낼 수 있다.
