군인연금법 제29조(행방불명자 등에 대한 퇴직급여 등)

① 제7조제1호에 따른 퇴직급여(이하 "퇴직급여"라 한다)를 받을 권리가 있는 사람이 1년 이상 행방불명인 경우에는 그의 상속인(유족의 범위에 해당하여야 한다. 이하 이 조에서 같다)이 될 사람의 청구에 의하여 그 퇴직급여를 그 상속인에게 지급할 수 있다.

② 제1항에 따라 상속인이 행방불명자의 퇴역연금을 청구하는 경우에는 그 행방불명자가 이 법에 따라 퇴역연금을 받을 권리가 있는 때부터의 해당 퇴역연금을 지급하고, 퇴역연금을 받을 권리가 있는 때부터 3년이 지나도 행방불명된 사람의 소재가 확인되지 아니하면 그 다음 달부터 해당 퇴역연금액의 60퍼센트를 지급한다.

③ 제2항에 따른 급여를 지급한 후 행방불명되었던 사람이 사망한 사실이 확인된 경우에는 사망한 사실이 확인된 날이 속하는 달의 다음 달부터 그 상속인에게 퇴역유족연금을 지급한다. 다만, 행방불명되었던 사람이 사망한 날이 제1항에 따른 급여를 지급한 날부터 3년 이내인 경우에는 사망한 날이 속하는 달의 다음 달부터 그 3년이 되는 날이 속하는 달까지 상속인이 받을 수 있는 퇴역유족연금과 실제 받은 급여의 차액에 대통령령으로 정하는 이자를 가산한 금액을 제47조에 따른 군인연금기금에 반납하여야 한다.

④ 행방불명되었던 사람이 생존한 사실이 확인된 경우에는 그 생존한 사실이 확인된 날이 속하는 달의 다음 달부터 그 행방불명되었던 사람에게 퇴역연금을 지급하여야 한다. 이 경우 제2항에 따라 퇴역연금의 60퍼센트를 상속인에게 지급한 경우에는 그 지급한 기간의 급여액과 지급하여야 할 급여액의 차액에 대통령령으로 정하는 이자를 가산한 금액을 지급하여야 한다.

⑤ 제1항에 따른 상속인이 2명 이상인 경우 상속인의 순위 및 퇴직급여의 지급에 관하여는 제10조 및 제11조를 준용하고, 제2항에 따라 급여를 받는 상속인의 수급권 상실 및 이전에 관하여는 제32조를 준용한다.
