군인연금법 제24조(분할연금과 퇴역연금과의 관계)

① 제22조에 따른 분할연금 수급권은 그 수급권을 취득한 후에 배우자였던 사람에게 생긴 사유로 퇴역연금의 수급권이 소멸ㆍ정지되어도 영향을 받지 아니한다. 다만, 형벌 등에 따른 사유로 배우자였던 사람의 퇴역연금액이 감액되거나 그 지급이 정지된 경우에는 제38조를 준용한다.

② 수급권자에게 둘 이상의 분할연금 수급권이 생기면 둘 이상의 분할연금액을 합하여 지급한다.

③ 분할연금 수급권자는 퇴역유족연금을 지급할 때 퇴역연금 수급권자로 보지 아니한다.

④ 분할연금 수급권자에게 퇴역연금 수급권이 발생한 경우에는 분할연금액과 퇴역연금액을 합하여 지급한다.

⑤ 분할연금 수급권이 소멸된 경우에는 그 사유가 발생한 다음 달부터 배우자였던 사람에게 분할되기 전의 금액을 지급한다.

⑥ 분할연금 수급권자와 그 배우자였던 사람이 모두 퇴역연금 수급권자인 경우에는 당사자들의 합의에 따라 각각의 분할연금을 지급하지 아니할 수 있다.
