군인연금법 제12조(급여의 수급자에 대한 특례)

① 군인 또는 군인이었던 사람이 사망한 경우에 급여를 받을 유족이 없을 때에는 대통령령으로 정하는 한도의 금액을 유족이 아닌 직계비속 또는 직계존속에게 지급하고, 직계비속 또는 직계존속도 없을 때에는 그 사망한 군인을 위하여 사용할 수 있다.

② 제1항에 따른 유족이 아닌 직계비속 또는 직계존속이 2명 이상 있을 때에 그 급여의 지급에 관하여는 제10조 및 제11조를 준용한다.
