군인사법 시행령 제5조(장기복무 장교 등의 전역지원 등)

① 법 제7조제1항제1호 단서, 제2호 단서, 제5호 단서 및 제6호 단서에 따라 장기복무 장교와 군의 필수 기술 분야에 종사하는 준사관 및 장기복무 부사관이 의무복무기간이 끝나기 전에 전역을 지원할 경우에는 한 차례 전역지원을 할 수 있는 해의 전년도 9월 30일까지 전역지원서를 참모총장에게 제출하여야 한다. 다만, 군의 필수 기술 분야에 종사하는 장기복무 부사관의 경우에는 법 제13조제3항에 따라 임용권이 위임된 장성급(將星級) 지휘관에게 전역지원서를 제출하여야 한다. <개정 2017.9.5, 2025.9.18>

② 참모총장(장기복무 부사관의 경우에는 임용권이 위임된 장성급 지휘관)은 제1항에 따른 전역지원서를 제출받았을 때에는 군인력 운영 현황 등을 고려하여 전역심사를 하여야 한다. <개정 2017.9.5>

③ 제1항에 따른 전역지원서를 제출한 사람에 대한 전역허가 여부 및 전역시기의 결정은 법 제43조제1항에 따라 전역 권한이 있는 사람이 한다.
