① 법 제12조에 따라 정착금ㆍ피해위로금ㆍ보상금 또는 의료지원금(이하 "피해위로금등"이라 한다)의 지급을 신청하고자 하는 자는 다음 각 호의 서류를 1부씩 위원회에 제출하여야 한다. <개정 2010.11.2, 2013.6.17, 2019.7.2>

② 제1항의 보상금 지급신청ㆍ수령에 있어서 사망자ㆍ행방불명자 또는 부상자의 유족의 경우에 같은 순위 재산상속인이 2명 이상일 때에는 별지 제4호서식의 유족대표자 선정서에 따라 유족대표자를 선정하여야 한다. 다만, 같은 순위 재산상속인 간의 합의가 불가능한 경우에는 그러하지 아니하다. <개정 2019.7.2>

③ 위원회는 제1항에 따라 피해위로금등의 지급신청을 받은 경우에 제1항 각 호의 관계서류가 첨부되어 있지 아니한 경우에는 신청인으로 하여금 이를 보완하게 하여야 한다.

④ 위원회는 제1항에 따른 피해위로금 지급신청서 등을 제출받은 경우에는 「전자정부법」 제36조제1항에 따른 행정정보의 공동이용을 통하여 신청인의 주민등록표 등본을 확인하여야 한다. 다만, 신청인이 확인에 동의하지 아니하는 경우에는 이를 첨부하도록 하여야 한다. <개정 2010.5.4, 2010.11.2>
