군사법원법 제403조(상소권회복 청구의 방식)

① 상소권회복 청구는 그 사유가 소멸한 날부터 상소 제기기간에 해당하는 기간 내에 서면으로 원심군사법원에 제출하여야 한다.

② 상소권회복의 청구를 할 때에는 원인이 된 사유를 소명하여야 한다.

③ 상소권회복의 청구를 한 사람은 청구와 동시에 상소를 제기하여야 한다.
