군사법원법 제264조(변사자의 검시)

① 변사자 또는 변사한 것으로 의심되는 사체가 제2조에 해당하는 사람의 사체일 때에는 군검사가 검시(檢視)하여야 한다. <개정 2016.1.6>

② 변사자 또는 변사한 것으로 의심되는 사체가 제2조에 해당하지 아니하는 사람의 사체일지라도 병영이나 그 밖의 군사용 청사, 차량, 함선 또는 항공기에서 발견되었을 때에는 군검사가 검시하여야 한다. <개정 2016.1.6>

③ 제1항 또는 제2항의 검시로 범죄의 혐의가 인정되고 긴급할 때에는 영장 없이 검증을 할 수 있다.

④ 군검사는 군사법경찰관이나 사법경찰관에게 제1항부터 제3항까지의 처분을 하게 할 수 있다. <개정 2016.1.6>
