군사기밀 보호법 제16조(신고ㆍ제출ㆍ삭제의 불이행)

① 군사기밀을 보관하는 사람이 이를 분실하거나 도난당한 경우에 지체 없이 그 사실을 소속 기관 또는 감독 기관의 장에게 신고하지 아니한 경우에는 3년 이하의 징역 또는 3천만원 이하의 벌금에 처한다. <개정 2014.5.9>

② 군사기밀을 습득하거나 타인으로부터 제공받아 점유한 사람이 수사기관이나 군부대로부터 제출요구를 받고 즉시 이를 제출하지 아니한 경우 2년 이하의 징역 또는 2천만원 이하의 벌금에 처한다. <개정 2014.5.9>

③ 압수의 목적물인 군사기밀이 「형사소송법」 제106조제3항 또는 같은 법 제219조에 따라 출력이나 복제의 방법으로 제출된 경우 그 점유자가 검사(군검사를 포함한다) 또는 사법경찰관(군사법경찰관을 포함한다)으로부터 컴퓨터용디스크, 그 밖에 이와 비슷한 정보저장매체에 남아 있는 군사기밀의 삭제 요구를 받고 즉시 이를 삭제하지 아니한 때에는 2년 이하의 징역 또는 2천만원 이하의 벌금에 처한다. <신설 2015.9.1, 2022.12.13, 2026.9.29>
