군사경찰의 직무수행에 관한 법률 시행령 제13조(신규 도입 위해성 군사경찰장비의 안전성 검사)

① 국방부장관은 위해성 군사경찰장비를 새로 도입하려는 경우 법 제11조제4항에 따라 안전성 검사를 실시하여 새로 도입하려는 위해성 군사경찰장비(이하 이 조에서 "신규도입장비"라 한다)가 사람의 생명이나 신체에 미치는 영향을 평가해야 한다.

② 제1항에 따른 안전성 검사는 신규도입장비와 관련된 분야의 외부 전문가가 신규도입장비의 주요 특성이나 작동원리에 기초하여 제시하는 검사방법 및 기준에 따라 실시한다. 이 경우 신규도입장비에 대하여 일반적으로 인정되는 합리적인 검사방법이나 기준이 있을 때에는 그 검사방법이나 기준에 따라 안전성 검사를 실시할 수 있다.

③ 법 제11조제4항 후단에 따라 안전성 검사에 참여한 외부 전문가는 안전성 검사가 끝난 날부터 30일 이내에 신규도입장비의 안전성 여부에 대한 의견을 국방부장관에게 제출해야 한다.

④ 국방부장관은 법 제11조제4항 전단에 따라 신규도입장비에 대한 안전성 검사를 실시한 날부터 3개월 이내에 다음 각 호의 내용이 포함된 안전성 검사 결과보고서를 국회 소관 상임위원회에 제출해야 한다.
