군무원인사법 제15조(승진)

① 군무원의 계급 간 승진은 근무성적평정, 경력평정, 그 밖의 능력의 실증(實證)에 따른다. 다만, 1급부터 3급까지의 일반군무원으로의 승진은 능력과 경력 등을 고려하여야 하며, 5급 일반군무원으로의 승진임용에 있어서는 승진시험을 거치도록 하되, 필요하다고 인정하는 경우에는 대통령령으로 정하는 바에 따라 인사위원회의 심사를 거쳐 임용할 수 있다. <개정 2010.3.26>

② 직무수행에 현저한 공적이 있는 우수 군무원으로서 대통령령으로 정하는 요건에 해당하는 사람에 대하여는 제1항에도 불구하고 특별승진임용을 하거나 일반군무원 승진시험에 우선 응시하게 할 수 있다. <개정 2010.3.26>

③ 계급별 승진소요최저연수(昇進所要最低年數), 승진의 제한, 그 밖에 승진에 필요한 사항은 대통령령으로 정한다.

④ 국방부장관은 군무원의 승진 대상자에 대하여 「국가정보원법」 제4조제4항의 위임에 따른 보안 업무에 관한 대통령령에 근거한 신원조사를 국가정보원장에게 의뢰한다. <신설 2024.2.6>
