국제형사사법 공조법 제17조(검사 등의 처분)

① 검사는 공조에 필요한 자료를 수집하기 위하여 관계인의 출석을 요구하여 진술을 들을 수 있고, 감정ㆍ통역 또는 번역을 촉탁할 수 있으며, 서류나 그 밖의 물건의 소유자ㆍ소지자(所持者) 또는 보관자에게 그 제출을 요구하거나, 행정기관이나 그 밖의 공사단체(公私團體)에 공조에 필요한 사실을 조회하거나 필요한 사항의 보고를 요구할 수 있다.

② 검사는 공조에 필요한 경우에는 판사에게 청구하여 발급받은 영장에 의하여 압수ㆍ수색 또는 검증을 할 수 있다.

③ 검사는 요청국에 인도하여야 할 증거물 등이 법원에 제출되어 있는 경우에는 법원의 인도허가 결정을 받아야 한다.

④ 검사는 사법경찰관리에게 제1항의 수사를 요청할 수 있고, 사법경찰관은 검사에게 신청하여 검사의 청구로 판사가 발부한 영장에 의하여 제2항에 따른 압수ㆍ수색 또는 검증을 할 수 있다. <개정 2026.3.24>
