국유재산법 제73조의2(도시ㆍ군관리계획의 협의 등)

① 중앙관서의 장이나 지방자치단체의 장은 국유재산에 대하여 「국토의 계획 및 이용에 관한 법률」에 따라 도시ㆍ군관리계획을 결정ㆍ변경하거나 다른 법률에 따라 이용 및 보전에 관한 제한을 하는 경우 대통령령으로 정하는 바에 따라 미리 해당 국유재산을 소관하는 총괄청이나 중앙관서의 장과 협의하여야 한다. <개정 2026.2.19>

② 중앙관서의 장등(다른 법령에 따라 국유재산의 관리ㆍ처분에 관한 사무를 위임 또는 위탁받은 자를 포함한다)은 「국토의 계획 및 이용에 관한 법률」 제65조제3항 또는 그 밖의 법률에 따라 국유재산인 공공시설의 귀속에 관한 사항이 포함된 개발행위에 관한 인ㆍ허가 등을 하려는 자에게 의견을 제출하려는 경우에는 대통령령으로 정하는 바에 따라 총괄청과 미리 협의하여야 한다. <신설 2017.12.26>

③ 총괄청이나 중앙관서의 장등은 국유재산을 효율적으로 관리하고 그 활용도를 높이기 위하여 필요하다고 인정하는 경우 「국토의 계획 및 이용에 관한 법률」에 따른 도시ㆍ군관리계획의 입안권자에게 해당 도시ㆍ군관리계획의 변경을 요청할 수 있다. <개정 2017.12.26, 2026.2.19>
