국유림의 경영 및 관리에 관한 법률 시행령 제16조(교환의 조건)

1. 법 제20조제1항제1호의 경우: 서로 유사한 재산으로서 교환하는 재산 한 쪽의 가격이 다른 쪽의 가격의 4분의 3 이상일 것

2. 법 제20조제1항제2호, 제2호의2, 제2호의3 및 제3호의 경우: 서로 유사한 재산으로서 교환하는 재산 한 쪽의 가격이 다른 쪽의 가격의 2분의 1 이상일 것. 이 경우 법 제20조제1항제3호에 따라 교환하려는 때에는 교환하여 새로 국유림에 포함되는 재산의 면적이 국유림에서 제외되는 재산의 면적보다 커야 한다.

3. 교환대상재산이 제12조제2항 각 호의 사유에 해당되지 아니할 것. 다만, 국유림의 효율적 경영ㆍ관리를 위하여 그 교환이 불가피하다고 산림청장이 인정하는 경우에는 교환할 수 있다.
