국방과학기술혁신 촉진법 제8조(국방연구개발사업 추진방법)

① 방위사업청장은 연구기관등으로 하여금 국방연구개발사업을 수행하게 할 수 있다. 이 경우 방위사업청장은 다음 각 호의 자와 국방연구개발사업에 관한 계약 또는 협약을 체결할 수 있으며, 제2조제5호가목에 따른 무기체계 연구개발사업을 수행하는 경우 계약을 원칙으로 하되 사업 특성에 따라 협약을 선택적으로 체결할 수 있고, 같은 호 나목부터 라목까지의 국방연구개발사업을 수행하는 경우 협약 체결을 원칙으로 한다.

② 방위사업청장은 제1항에 따른 협약을 체결한 사업의 수행에 드는 비용의 전부 또는 일부를 출연할 수 있다.

③ 제1항 후단에도 불구하고 방위사업청장이 「국방과학연구소법」에 따라 설립된 국방과학연구소에 국방연구개발사업을 수행하게 하는 경우에는 그 사업의 수행에 드는 비용을 출연할 수 있다.

④ 연구개발주관기관은 국방연구개발사업을 효과적으로 수행하기 위하여 필요한 경우 연구기관등과 계약 또는 협약을 체결하여 연구개발주관기관이 수행하는 국방연구개발사업의 일부를 위탁하여 수행하게 할 수 있다. 이 경우 계약 또는 협약 체결원칙은 제1항 후단을 준용한다.

⑤ 방위사업청장이 제1항에 따른 계약을 체결하는 때에는 이 법에서 정한 것을 제외하고는 「방위사업법」 제46조 및 「국가를 당사자로 하는 계약에 관한 법률」에 따른다.

⑥ 방위사업청장은 국방연구개발사업을 효율적으로 추진하기 위하여 필요하다고 인정하는 경우에는 「방위사업법」 제32조에 따른 국방기술품질원 또는 그 밖에 대통령령으로 정하는 기관으로 하여금 국방연구개발사업의 과제기획ㆍ관리 및 평가(이하 "기획등"이라 한다)에 관한 업무를 지원하게 할 수 있다. 이 경우 방위사업청장은 기획등의 수행에 드는 비용의 전부 또는 일부를 출연할 수 있다.

⑦ 제1항에 따른 국방연구개발사업에 관한 계약 또는 협약의 체결ㆍ변경ㆍ해약에 관한 사항, 제6항에 따른 기획등의 업무의 범위에 관한 사항, 국방연구개발의 절차, 출연금의 지급ㆍ사용 및 관리에 필요한 사항 등은 대통령령으로 정한다.

⑧ 방위사업청장은 기술력을 갖춘 중소기업을 육성하기 위하여 제1항에 따라 계약 또는 협약을 체결하여 연구개발주관기관 또는 연구개발참여기관을 선정하는 경우 방위사업청장이 정하여 고시하는 품목에 대하여는 「중소기업기본법」 제2조에 따른 중소기업자를 우선 선정할 수 있다.

⑨ 국방부장관은 제1항부터 제8항까지를 준용하여 제2조제5호마목에 따른 전력지원체계 연구개발에 관한 사업을 수행할 수 있다. 이 경우 "방위사업청장"은 "국방부장관"으로 본다.
