Enforcement Rule of the National Pension Act, Article 16 (Reports on Changes in Insured Person Details)
① 사용자는 해당 사업장가입자가 다음 각 호의 어느 하나에 해당하는 경우에는 법 제21조제1항에 따라 그 사실이 발생한 날이 속하는 달의 다음 달 15일까지 별지 제13호서식의 사업장가입자 내용변경신고서를 공단에 제출하여야 한다.
(1) Where a workplace-based insured person falls under any of the following cases, the employer shall submit a report on change in details of a workplace-based insured person in Form No. 13 to the Service by the 15th day of the month following the month in which the fact occurred, pursuant to Article 21 (1) of the Act:
1. 성명이 변경된 경우
1. Where his or her name has changed;
2. 특수 직종 근로자에 해당하게 되거나 해당하지 아니하게 된 경우
2. Where he or she becomes or ceases to be a worker in a special occupation.
② 다음 각 호의 어느 하나에 해당하는 경우에는 법 제21조제2항에 따라 그 사실이 발생한 날이 속하는 달의 다음 달 15일까지 지역가입자는 별지 제1호서식의 지역가입자 내용변경신고서를 공단에 제출하여야 하고, 임의가입자와 임의계속가입자는 별지 제2호서식의 임의ㆍ임의계속가입자 내용변경신고서를 공단에 제출하여야 한다. <개정 2016.11.29>
(2) In any of the following cases, a locally-covered insured person shall submit a report on change in details of a locally-covered insured person in Form No. 1, and a voluntarily insured person and a voluntarily and continuously insured person shall submit a report on change in details of a voluntarily or voluntarily and continuously insured person in Form No. 2, to the Service by the 15th day of the month following the month in which the fact occurred, pursuant to Article 21 (2) of the Act:
1. 성명이나 주소(외국인의 국내체류지 및 외국국적동포의 국내거소를 포함한다)가 변경된 자로서 「주민등록법」 제13조, 「출입국관리법」 제35조ㆍ제36조제1항 및 「재외동포의 출입국과 법적 지위에 관한 법률」 제6조 및 같은 법 시행령 제13조제1항제4호ㆍ제2항에 따라 성명이나 주소의 정정 신고를 하지 아니한 경우
1. Where a person whose name or address (including the place of stay in Korea of a foreigner and the domestic place of residence of an overseas Korean national of foreign nationality) has changed has not filed a report of correction of name or address under Article 13 of the Resident Registration Act, Articles 35 and 36 (1) of the Immigration Act, and Article 6 of the Act on the Immigration and Legal Status of Overseas Koreans and Article 13 (1) 4 and (2) of the Enforcement Decree of the same Act;
2. 임의계속가입자가 국민연금 적용사업장에 종사하게 되거나 종사하지 아니하게 된 경우
2. Where a voluntarily and continuously insured person begins or ceases to work at a workplace covered by the National Pension;
3. 특수 직종 근로자에 해당하게 되거나 해당하지 아니하게 된 경우
3. Where he or she becomes or ceases to be a worker in a special occupation;
4. 농어업인인 지역가입자나 지역임의계속가입자가 농어업인에 해당하지 아니하게 된 경우
4. Where a locally-covered insured person or a locally-covered voluntarily and continuously insured person who is a farmer or fisher ceases to be a farmer or fisher.
