국가재정법 제40조(독립기관의 예산)

①정부는 독립기관의 예산을 편성할 때 해당 독립기관의 장의 의견을 최대한 존중하여야 하며, 국가재정상황 등에 따라 조정이 필요한 때에는 해당 독립기관의 장과 미리 협의하여야 한다. <개정 2020.6.9>

②정부는 제1항의 규정에 따른 협의에도 불구하고 독립기관의 세출예산요구액을 감액하고자 할 때에는 국무회의에서 해당 독립기관의 장의 의견을 들어야 하며, 정부가 독립기관의 세출예산요구액을 감액한 때에는 그 규모 및 이유, 감액에 대한 독립기관의 장의 의견을 국회에 제출하여야 한다. <개정 2020.6.9>
