국가유산수리 등에 관한 법률 제28조(하도급 대금의 지급 등)

① 수급인은 발주자로부터 도급받은 국가유산수리에 대한 준공금을 받았을 때에는 하도급 대금의 전부를, 기성금(旣成金)을 받았을 때에는 하수급인이 국가유산수리한 부분에 상당한 금액을 각각 지급받은 날(수급인이 발주자로부터 국가유산수리 대금을 어음으로 받았을 때에는 그 어음만기일을 말한다)부터 15일 이내에 하수급인에게 현금으로 지급하여야 한다. <개정 2023.8.8>

② 수급인은 발주자로부터 선급금을 받은 경우에는 하수급인이 국가유산수리를 착수할 수 있도록 그가 받은 선급금의 내용과 비율에 따라 하수급인에게 선급금을 지급하여야 한다. 이 경우 수급인은 하수급인이 선급금을 반환하여야 할 경우에 대비하여 하수급인에게 보증을 요구할 수 있다. <개정 2023.8.8>

③ 수급인은 하도급을 한 후 설계 변경 또는 물가 변동 등의 사정으로 도급 금액이 조정되는 경우에는 조정된 국가유산수리 금액과 비율에 따라 하수급인에게 하도급 금액을 늘리거나 줄여서 지급할 수 있다. <개정 2023.8.8>
