광산피해의 방지 및 복구에 관한 법률 시행령 제27조(부담금의 직권조정)

①산업통상부장관은 법 제24조에 따라 부과한 부담금이 다음 각 호의 어느 하나에 해당하는 경우 등 부과된 부담금을 조정할 필요가 발생한 경우에는 그 부담금을 다시 산정하여 조정한다. 이 경우 이미 납부한 금액과 조정된 금액에 차이가 있는 때에는 그 차액을 다시 부과하거나 반환하여야 한다. <개정 2008.2.29, 2013.3.23, 2025.10.1>

②제1항 후단에 따라 부담금의 차액을 반환하는 경우에는 그 부담금이 최종 납부된 날의 다음날부터 반환되는날까지의 일수에 대하여 적정이자율을 적용하여 산출한 이자를 포함하여야 한다.
