광산안전법 제5조의2(특례구역)

① 광업권자 또는 조광권자는 대통령령으로 정하는 광산 중 가연성가스에 관한 조치를 취할 필요가 없다고 인정되는 구역을 특례구역으로 정할 수 있다.

② 광업권자 또는 조광권자는 제1항에 따른 특례구역(이하 "특례구역"이라 한다)에서 대통령령으로 정하는 바에 따라 제5조에 따른 조치의 일부를 생략할 수 있다. 다만, 가스발생량의 측정 및 통기시설의 확보 등 산업통상부령으로 정하는 조치는 생략할 수 없다. <개정 2025.10.1>

③ 제2항에 따라 특례구역에서 제5조에 따른 안전조치의 일부를 생략하려는 광업권자 또는 조광권자는 다음 각 호의 사항을 제11조에 따라 제정한 안전규정에 정하여 산업통상부장관의 승인을 받아야 한다. <개정 2025.10.1>

④ 광업권자 또는 조광권자는 제3항에 따라 안전규정을 승인받은 경우 해당 특례구역에서 같은 항 제2호에 따른 안전조치를 하여야 한다.
