Enforcement Decree of the Customs Act, Article 251-2 (Amount of Compensation for Losses from Inspection of Goods, etc.)

① 법 제246조의2제1항에 따른 손실보상의 대상은 세관공무원의 적법한 물품검사로 손실이 발생한 다음 각 호의 어느 하나에 해당하는 것으로 한다. <신설 2024.2.29>

가. 제1항제1호에 해당하는 경우: 법 제30조부터 제35조까지의 규정에 따른 해당 물품의 과세가격에 상당하는 금액. 다만, 과세가격에 상당하는 금액을 산정할 수 없는 경우에는 구매가격 및 손실을 입은 자가 청구하는 금액을 고려하여 관세청장이 합리적인 범위에서 인정하는 금액으로 한다.
