관세법 시행령 제245조(반입명령)

①관세청장 또는 세관장은 수출입신고가 수리된 물품이 다음 각 호의 어느 하나에 해당하는 경우에는 법 제238조제1항에 따라 해당 물품을 보세구역으로 반입할 것을 명할 수 있다. 다만, 해당 물품이 수출입신고가 수리된 후 3개월이 지났거나 관련 법령에 따라 관계행정기관의 장의 시정조치가 있는 경우에는 그러하지 아니하다. <개정 2008.2.22, 2011.4.1, 2017.3.27, 2025.2.28>

②관세청장 또는 세관장이 제1항의 규정에 의하여 반입명령을 하는 경우에는 반입대상물품, 반입할 보세구역, 반입사유와 반입기한을 기재한 명령서를 화주 또는 수출입신고자에게 송달하여야 한다.

③관세청장 또는 세관장은 명령서를 받을 자의 주소 또는 거소가 불분명한 때에는 관세청 또는 세관의 게시판 및 기타 적당한 장소에 반입명령사항을 공시할 수 있다. 이 경우 공시한 날부터 2주일이 경과한 때에는 명령서를 받을 자에게 반입명령서가 송달된 것으로 본다.

④제2항 또는 제3항의 규정에 의하여 반입명령서를 받은 자는 관세청장 또는 세관장이 정한 기한내에 제1항 각호의 1에 해당하는 것으로서 명령서에 기재된 물품을 지정받은 보세구역에 반입하여야 한다. 다만, 반입기한내에 반입하기 곤란한 사유가 있는 경우에는 관세청장 또는 세관장의 승인을 얻어 반입기한을 연장할 수 있다.

⑧관세청장은 보세구역 반입명령의 적정한 시행을 위하여 필요한 반입보세구역, 반입기한, 반입절차, 수출입신고필증의 관리방법 등에 관한 세부기준을 정할 수 있다.
