관세법 시행령 제204조(외국물품과 내국물품의 혼용 비율에 따른 과세 적용 승인)

①법 제188조 단서에 따른 승인을 얻고자 하는 자는 다음 각 호의 사항을 기재한 신청서를 세관장에게 제출해야 한다. <개정 2026.2.27>

②제1항의 규정에 의한 승인을 할 수 있는 경우는 작업의 성질ㆍ공정 등에 비추어 당해 작업에 사용되는 외국물품과 내국물품의 품명ㆍ규격별 수량과 그 손모율이 확인되고, 제4항의 규정에 의한 과세표준이 결정될 수 있는 경우에 한한다.

③세관장은 제1항의 규정에 의한 승인을 얻은 사항중 혼용하는 외국물품 및 내국물품의 품명 및 규격이 각각 동일하고, 손모율에 변동이 없는 동종의 물품을 혼용하는 경우에는 새로운 승인신청을 생략하게 할 수 있다.

④법 제188조 단서에 따라 외국물품과 내국물품의 혼용 비율에 따른 과세 적용 승인을 받은 때에는 해당 혼용으로 생긴 제품중에서 그 원료 또는 재료중 외국물품의 가격(종량세물품인 경우에는 수량을 말한다)이 차지하는 비율에 상응하는 분을 외국으로부터 우리나라에 도착된 물품으로 본다. <개정 2026.2.27>
