Enforcement Decree of the Customs Act, Article 189-2 (Decision on the Number of New Permits for Duty-Free Shops, etc.)

① 재정경제부장관은 법 제176조의4에 따른 보세판매장 제도운영위원회(이하 "보세판매장 제도운영위원회"라 한다)의 심의ㆍ의결을 거쳐 공항 및 항만의 보세구역 외의 장소에 설치되는 보세판매장(이하 "시내보세판매장"이라 한다)의 신규 특허 수를 결정할 수 있다. <개정 2025.12.30>

② 보세판매장 제도운영위원회는 다음 각 호의 어느 하나에 해당하면 특별시, 광역시, 특별자치시, 도 및 특별자치도(이하 "광역자치단체"라 한다)에 설치되는 법 제176조의2제1항에 따른 중소기업등(이하 "중소기업등"이라 한다)이 아닌 자에 대해 부여할 수 있는 시내보세판매장의 신규 특허 수를 심의ㆍ의결할 수 있다. 이 경우 보세판매장 제도운영위원회는 기존 보세판매장의 특허 수, 최근 3년간 외국인 관광객의 동향 등 시장상황을 고려하여 심의ㆍ의결해야 한다.

1. 광역자치단체별 시내보세판매장 매출액이 전년 대비 2천억원 이상 증가한 경우

③ 보세판매장 제도운영위원회는 다음 각 호의 어느 하나에 해당하면 해당 광역자치단체에 설치되는 시내보세판매장의 신규 특허 수를 심의ㆍ의결할 수 있다. 이 경우 보세판매장 제도운영위원회는 기존 보세판매장의 특허 수, 외국인 관광객 수의 증가 추이 등을 고려하여 심의ㆍ의결해야 하되, 제2항 각 호의 요건은 적용하지 않는다.

3. 시내보세판매장이 설치되지 않은 광역자치단체의 장이 중소기업등이 아닌 자가 시내보세판매장을 설치할 수 있도록 하려는 경우로서 해당 광역자치단체의 장이 시내보세판매장의 설치를 요청하는 경우

4. 중소기업등이 광역자치단체에 시내보세판매장을 설치하려는 경우

④ 재정경제부장관은 제2항 및 제3항에 따른 보세판매장 제도운영위원회의 심의ㆍ의결 결과를 관세청장에게 통보해야 한다. <개정 2025.12.30>

⑤ 제2항 및 제3항에 따른 시내보세판매장의 설치ㆍ운영에 관한 특허절차는 제192조의5를 준용한다.

⑥ 제1항부터 제5항까지에서 규정한 사항 외에 시내보세판매장의 신규 특허 수 결정에 필요한 세부사항은 관세청장이 정하여 고시한다.
