공직자 등의 병역사항 신고 및 공개에 관한 법률 시행령 제9조(병역사항 변동신고서의 제출 등)

① 법 제5조제1항제3호 및 같은 조 제2항에서 "병역 변동사항"이란 다음 각 호의 어느 하나에 해당하는 경우 그 병역사항을 말한다. <개정 2013.12.4, 2016.6.14, 2016.11.29, 2019.10.29, 2020.12.29>

② 신고의무자는 법 제5조제1항 각 호의 어느 하나에 해당하는 경우에는 병역사항 변동신고서를 신고기관의 장에게 제출하여야 한다.

③ 제2항에 따른 병역사항 변동신고에 관하여는 제5조와 제6조를 준용한다. 이 경우 "병역사항 신고서"는 "병역사항 변동신고서"로 본다.

④ 신고기관의 장은 제2항에 따라 병역사항 변동신고를 받은 때에는 병역사항 변동신고자 명부에 병역사항 변동신고서를 첨부(정보통신망을 이용하여 병역사항 변동신고를 한 경우에는 첨부하지 아니한다)하여 병무청장이나 지방병무청장에게 그 사실을 통보하여야 한다. 다만, 병역사항 공개보류자의 경우에는 그러하지 아니하다.

⑤ 신고기관의 장은 제4항에 따라 병무청장이나 지방병무청장에게 병역사항 변동신고서를 통보하는 때에는 그 사본 1부를 해당 신고기관에 보관하여야 한다.

⑥ 병무청장은 법 제5조제2항에 따라 병역 변동사항을 확인하기 위하여 필요한 경우에는 신고대상자의 병역사항을 보유ㆍ관리하고 있는 각 군 참모총장(해병대의 경우에는 해병대사령관을 말한다) 또는 관계 행정기관의 장에게 관련 자료의 제출을 요청할 수 있다. <신설 2019.10.29>
